The Market Surveillance Office of the Hamburg Insurance Exchange

 

The legal basis for setting up Market Surveillance Office at German exchanges is set down in the German Stock Exchange Law, article 4 (1) which states:

  • The exchange shall establish and operate a market surveillance office according to the stipulations of the Stock Exchange Regulatory Agency authorised to monitor and supervise trading and the management of transactions.

    The German Stock Exchange Law can be reviewed in its entirety at Bundesanstalt für Finanzdienstleistungsaufsicht (Federal Agency for the Supervision of Financial Services) web site (http://www.bafin.de/gesetze/boerseng.htm).

The Market Surveillance Office performs the following tasks:

(1) As an independent exchange authority the market surveillance office is legally appointed to monitor and supervise exchange trading and transaction management. This entails:

  1. Compliance with the laws, rules and regulations governing the Insurance Exchange as well as regulations stipulated by the Exchange Council and other rules and regulations;
  2. Compliance with the standard customs of the trade as set down in the regulations governing insurance policy transactions at the Insurance Exchange;
  3. Maintenance of order in the Exchange Hall;
  4. Strict observation that authorised persons only have access to and may participate in trading at the Exchange.

(2) The head of the Market Surveillance Office shall report to the Stock Exchange Regulatory Agency on a regular basis.

 

(3) In the interest of carrying out its function the Market Surveillance Office is entitled to request information from the Exchange itself, persons authorised to use the Exchange as well as the companies or businesses they represent.

 

(4) Should the Market Surveillance Office discover actual facts justifying the assumption of an infringement of the rules and regulations governing exchange transactions or other forms of malgovernance which might be detrimental to Exchange trading or the management of transactions it shall report such detection to the Stock Exchange Regulatory Agency as well as to the executive management of the Exchange at once. The Exchange management shall take urgent steps to restore and secure exchange trading and transaction management and shall, without further delay, report to the Stock Exchange Regulatory Agency what immediate steps were taken.
